Lightfoot Wins Summary Judgment for National Cemetery Property and Services Provider

Lightfoot attorneys Terry McCarthy and Jonathan Little recently obtained summary judgment on all claims made against a national cemetery property and services company, and its Alabama subsidiary, in the Circuit Court of Madison County, Alabama. The plaintiffs claimed that the defendants mishandled and damaged the corpse of their mother and alleged tort of outrage, negligence, fraud, breach of contract and other legal claims. Lightfoot filed a motion for summary judgment arguing that there was no evidence that the defendants breached the standard of care, nor was there evidence of any other kind of wrongdoing. After briefing and oral argument, the court granted the motion for summary judgment and dismissed all claims.
