Lightfoot Obtains Summary Judgment for Insurance Company and Benefits Group in Breach of Contract/Bad Faith Case

On November 7, 2016, Lightfoot lawyer Terry McCarthy obtained summary judgment for an out of state insurance company and benefits group in a breach of contract/bad faith action filed by a beneficiary to an accidental death policy in the U.S. District Court for the Northern District of Alabama.
The plaintiff alleged that defendants ignored and refused to review medical records relating to the insured’s death in order to avoid paying the claim. The Court granted summary judgment in favor of defendants on all counts. The Court determined that the plaintiff failed to provide any evidence to support her claim that defendants breached the terms of the insurance policy when they refused to pay benefits, and there was no evidence that defendants exercised bad faith in handling the claim.
