GE-Supplier Alpha Source, Inc. Dismissed from Texas Antitrust Suit

Lightfoot partners John M. Johnson and Wes Gilchrist and associate Brian P. Kappel obtained dismissal of Alpha Source, Inc., an independent distributor of medical equipment and service parts manufactured by General Electric Company and others. Plaintiffs filed suit in the U.S. District Court for the Eastern District of Texas alleging that an exclusive distributorship agreement between GE and Alpha Source violated the Sherman Act and Clayton Act. Lightfoot filed a motion to dismiss, arguing that the agreement was legal and that otherwise plaintiffs have failed to allege a federal antitrust violation. After briefing and oral argument, the court granted Alpha Source’s motion to dismiss pursuant to Rule 12(b)(6).
