Alabama Supreme Court Upholds Lightfoot Client’s Arbitration Provision

BIRMINGHAM, Ala. (April 26, 2018) — In a 9-0 ruling, the Alabama Supreme Court recently reversed a Jefferson County circuit court decision denying a motion from our client, a cemetery property and service provider, to compel arbitration of a claim brought against it. The trial court had held that the provision was unenforceable.
In its ruling overturning the trial court, the Alabama Supreme Court found that the provision was enforceable and directed the trial court to enter an order granting the motion to compel arbitration.
